Ohio's Voluntary Action Program

Project Description: An industrial site was for sale.  However, potential buyers were concerned about the environmental condition of the site and hesitant to take possession of the property. 
 
Services Provided: A RCRA closure was performed so that the property would be eligible for the Voluntary Action Program.  A Phase I and II property assessment was then conducted in accordance with the protocol of Ohio's Voluntary Action Program.  Following risk-based modeling of conditions at the site, a no further action letter (NFA) was issued by Smalley & Associates.
Resolution: Ohio EPA has found the NFA complete and technically adequate, and issued a covenant not to sue.  Liability was greatly reduced for both the buyer and the seller, and the property sold.

Project Type: Phase I and II Environmental Site Assessment (ESA)
  
Project Location: Preble County, Ohio
  
Project Description: A client was interested in purchasing property, but wanted to ensure that there was no contamination risk prior to the purchase.
  
Services Provided: Smalley & Associates Inc. completed a Phase I ESA according to ASTM standards.  Areas of environmental concern were discovered during the Phase I ESA.  A Phase II ESA was performed to address these areas.  In this investigation Smalley & Associates drilled several bores and sampled both soil and groundwater. Several soil bores were advanced to ground water.  
  
Resolution: The site was found to be free of soil and ground water contamination, and the client could purchase the property with peace of mind.

Project Type: Remediation
   
Project Location: Licking County, Ohio
   
Project Description: Following Phase I and II investigations performed by Smalley & Associates, petroleum contamination was found on a commercial property.  The site itself was formerly on land owned by a bulk oil plant, and three other filling stations with documented releases were in the vicinity.
   
Services Provided: Due to the complexity involved with determining who was responsible for the contamination on the site, it was found to be simpler and more cost effective to remediate the site to standards than to engage in costly investigations and litigation.  Smalley & Associates injected pre-engineered bacteria and nutrients into numerous locations on the property and performed follow-up sampling.
Resolution: The bacteria degraded petroleum levels to below action levels and the property could be sold successfully.  Furthermore, if contamination should migrate onto the site at a later date, the present owners have documentation to show that any bulk plant activities performed on the site are not responsible.

Project Type: Federal Environmental Assessment
  
Project Location: Muskingum County, Ohio
  
Project Description: The client was required to complete a Federal Site Assessment for the construction of a service road to an industrial park. 
   
Services Provided: An environmental assessment was performed to applicable standards.  A Phase I Archaeological Study was recommended and the proper paperwork was submitted to Federal authorities.
   
Resolution:

The site assessment was accepted and the requested Federal monies were granted to assist in construction of the road.

Project Type: Hydrogeological Studies and Groundwater Monitoring
  
Project Location: Fairfield County, Ohio
   
Project Description: During removal and closure of an underground storage tank site, contamination was discovered above applicable action levels.  
  
Services Provided:

Seven test wells revealed contamination levels above categorical action levels established by OAC rule 1301:7-9-13. The extent of contamination was defined and a remediation plan submitted to Ohio's Bureau of Underground Storage Tank Regulation (BUSTR).  and implemented following acceptance by BUSTR
  

Resolution: The remediation plan was accepted by BUSTR and has been initiated.

Project Type: UST Removal and Installation
  
Project Location: Athens County, Ohio
 
Project Description: Nine UST's (Underground Storage Tanks) were removed with their piping system.  Six UST's were subsequently installed following State Fire Marshall, Ohio EPA, and Federal guidelines.
 
Services Provided:

Prior to excavation of the old tanks, investigations including a magnetometer scan revealed two additional USTs on the property. Both unknown USTs were registered prior to removal and the owner was advised to pay into Ohio PUSTR's Petro Fund to avoid environmental fines.

The USTs were safely removed following purging of organic vapors. 

A proper closure report was completed on the removed tanks and 6 new USTs were installed, along with a new piping system, leak detection, and corrosion monitoring devices.  All operations were performed to state and federal guidelines. 
   

Resolution: The liability of old tanks was removed and the facility was brought up to date with newer standards.
